Chicago Proof of Vaccination Explained
Q. What does the recent “Public Health Order No. 2021-2 - Proof of Vaccination in Public Places” (the “Order”) mean for rental buildings?
A. The Order provides that proof of vaccination is required for entry into the “indoor portion of a Covered Location” beginning on January 3, 2022.
Covered Locations include the following:
Establishments where food and/or beverages are served; and
Gym and fitness venues; and
Entertainment and recreation venues.
Please note that Covered Locations must “develop and keep a written record describing the protocol for implementing and enforcing the requirements” of the Order and post signage “at each publicly accessible entrance to the covered location and at least one location inside the covered location that is conspicuously visible, informing patrons of the full vaccination requirement.” See Public Health Order No. 2021-2 at Section 4.
**It is important to note that Covered Locations do not include locations “in residential or office buildings the use of which is limited to residents, owners, or tenants of that building, or to food service establishments providing only charitable food services, such as soup kitchens.” See Public Health Order No. 2021-2 (emphasis added).
Thus, we would recommend that you restrict access to the Fitness Center to RESIDENTS ONLY (i.e. no guests shall be permitted) or prepare to require proof of vaccinations.
